1.1 The following sets out the Terms and Conditions for Covet-Me Ltd (“Covet-Me”), a company registered in the United Kingdom under the registration number 13279035, and registered address of 39 Dovedale Circle, Ilkeston, England, DE7 8SE.
1.2 These Terms and Conditions apply in whole or in part to all individuals and entities who use, interact with, make a purchase, upload content or simply visit this Site (insert link to Site). By visiting or interacting with this Site, you agree to the applicability of these Terms and Conditions to the contract between you and Covet-Me. For this reason, it is important that you take your time to read this document carefully.
1.3 This Site is open to worldwide however, these Terms and Conditions are governed by, and construed in accordance with, the law of England and Wales. If you are accessing this Site from outside of the United Kingdom you, as a user of this Site, are solely responsible for complying with all local laws and regulations.
2.1 Covet-Me is a social media platform that allows its users to create a User Account, which in turn allows the User to become a Subscriber or a Content Creator.
3.1 Users may only visit or use this Site if they are at least 18 years of age. None of the content on this Site should be viewed by anyone under the age of 18 years.
Under these Terms and Conditions, a User is an individual who uses the Site in order to view Content uploaded by Content Creators. This section only apply to Users of the Site.
4.1.1 In order to become a User of this Site, you must register and create a User Account. In creating this account, you must provide Covet-Me with certain personally identifiable information including, but not limited to, a valid email address, a username and a password.
4.1.2 For more information about how we collect, process and store your personally identifiable information please read our Privacy Policy (insert link).
4.2.1 In order to view the Content that is uploaded by Content Creator’s, you must subscribe by paying the Content Creator’s subscription fee by providing your payment details (more information regarding payment options is provided in section Covet-Me below). This fee is unique to each Content Creator and is non-negotiable. For more information regarding Content Creator’s subscriptions fees please see section Covet-Me below.
4.2.2 All subscriptions will auto renew if the option has been selected by the User. Subscriptions will not auto renew without the user’s permission.
4.2.3 The subscription payment will be taken each month on the date in which the first payment was taken.
4.3.1 All payments made through this Site should be made through our online payment service, Stripe. For more information regarding the Terms and Conditions or Privacy Policy of Stripe please visit their Site directly.
4.4.1 You can cancel any of your Subscriptions at any time whilst still continuing to have access to Content until the end of your billing period.
4.4.2 In accordance with governing law, some online purchases will be eligible for cancellation and a full refund however, limitations do apply. In any event, the cancellation must occur within 14 days of payment.
4.4.3 Please note that all refunds are subject to limitations and are awarded at the Sites discretion.
4.5.1 Covet-Me retains exclusive interest in and ownership of its Intellectual Property in regards to this Site. Nothing in these Terms and Conditions will function to transfer the Intellectual Property rights to the User.
4.6.1 This Site must only be used in compliance with these Terms and Conditions. You must not use this Site in a manner that is unlawful or fraudulent. You must not knowingly cause harm to the Site by uploading; sending or in any other way transmitting data that contains any form of virus or malware or any other code designed to adversely affect any hardware, software, or data of any kind. You must not knowingly cause harm to any other user of our Site.
4.6.2 By registering a User Account with Covet-Me you agree that:
a. all User Account information is truthful and accurate;
b. you will not copy, reproduce, distribute or modify works from any portion of the Site without the lawful permission of both the Site and the Content Creator; and
c. you will not use the Site for the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content.
4.7.1 If any User has a dispute regarding the Content available under any of the User Subscriptions a dispute may be made via email or by following this link (INSERT LINK). The dispute should outline the identification of the Content Creator, the nature of the issue and where applicable the date any Content was viewed or added to the Content Creators page.
4.7.2 Disputes related to the User’s experience will be addressed between the Site and the Content Creator. These issues may include minimal content, duplication of images or Content that is available elsewhere free of charge. The Content Creator will be given the opportunity to resolve the issue but if they are unable to the User’s Subscription to the Creator’s Content can be cancelled and their most recent month subscription fee for that page refunded.
4.7.3 If the dispute is related to Content the User believes is illegal or in violation of other laws such as Copyright or Data Protection the Site will immediately investigate and where appropriate the Content will be removed and where required by law reported to authorities (for example, child exploitation or revenge porn).
Under these Terms and Conditions, a Content Creator is an individual who Uses this Site in order to upload Content in exchange for payment. This section is only relevant to Content Creators.
5.1.1 In order to become a Content Creator on this Site, you must register and create a User Account. The User may create either a Standard User account (to then be upgraded to a Content Creator Account) or a Content Creator Account. In creating either a Content Creator Account or a Standard User Account you must provide Covet-Me with certain personally identifiable information including, but not limited to, a valid email address, a username, a password, ID and your bank account details.

5.2.1 By creating and uploading Content onto this Site, you authorise your Subscribers to access and view (without downloading, copying or sharing) your Content for their own personal and lawful use.
5.2.2 By uploading Content, you agree that:
a. you own, have a license to, or otherwise control the rights of the images that you upload;
b. you will not upload any content which features any person under the age of 18 years;
c. you have gained confirmation that any featuring third parties are above the age of 18 years; and
d. you have gained permission (i.e. written consent) from any featuring third party.
The Content Creator should be prepared to hand over proof of consent and/or the age of any featured third parties to Covet-Me if requested by Covet-Me or any relevant third party.
5.3.1 All subscription fees are set by the Content Creator themselves.
5.3.2 Covet-Me does not have any say in what fee is charged however, Content Creators must ensure that the fee they charge is reasonable in all circumstances.
5.4.1 All subscription fee payments (i.e. revenue) will be collected from the Users by the Covet-Me.
5.4.2 Covet-Me will retain 15%of this revenue, with the remaining 85% being paid to the Content Creator, unless the Content Creator has been referred to the Site. In which case Covet-Me will retain 10% of the revenue with 5% of the revenue being paid to the referrer (more information regarding the Referral Program can be found in section Covet-Me below).
5.4.3 In order for Content Creators to receive their revenue, the Content Creator will need to add at least one payment method to their account.
5.4.4 All revenue generated by the Content Creator can be withdrawn by the Content Creator in several ways: manually, weekly or monthly. The Content Creator can select the method in which the revenue is withdrawn via their Account.
5.5.1 Covet-Me retains exclusive interest in and ownership of its Intellectual Property in regards to this Site. Nothing in these Terms and Conditions will function to transfer the Intellectual Property rights to the User.
5.5.2 All Content Creators will retain exclusive interest in and ownership of its Intellectual Property of the Content that they upload to the Site.
5.6.1 Content Creators shall indemnify and hold harmless the Site from any liabilities, costs, expenses, damages any losses caused directly or indirectly from any breach by the Content Creator of these Terms and Conditions or harm caused to any third party as a result of the Content Creators use of this site.
5.7.1 This Site must only be used in compliance with these Terms and Conditions. You must not use this Site in a manner that is unlawful or fraudulent. You must not knowingly cause harm to the Site by uploading; sending or in any other way transmitting data that contains any form of virus or malware or any other code designed to adversely affect any hardware, software, or data of any kind. You must not knowingly cause harm to any other user of our Site.
6.1 Covet-Me offers a referral program which gives individuals an incentive to introduce new Content Creators to the Site. These payments are known as Commission Payments.
6.2 This clause sets out when Covet-Me Commission Payments will be made.
6.3 Commission Payments are only available to those who successfully refer an individual to the Site. This individual must become a Content Creator, must upload Content and generate revenue through the Site.
6.4 The referrer will then receive Commission Payments each month of 5% of the revenue that the Content Creator has generated through their subscriptions.
6.5 This is a life time Program, meaning that the referrer will receive 5% of the Content Creators revenue for the remained of the life of the Site or the life of the Content Creators account.
6.6 All Commission Payments will be paid to the referrer on either a weekly, monthly or manual basis. Commission Payments will be made up of the Content Creator’s own earnings in addition to the 5% Commission Payments. All manually withdrawn payments of revenue shall include the revenue generated until the point of application to withdrawal. A Content Creator can only withdraw funds which have already cleared which can take up to 7 days.
7.1 The Site strives to provide a secure and rewarding experience for all its Users and Content Creators. In doing so this Site puts forward its best efforts to ensure the safety, security and accessibility of this Site. However, this Site cannot be held liable for any damaged directly or indirectly resulting from the use of this Site except where expressly required by law such as for gross negligence or wrongful death.
7.2 Liability, if any, shall be limited in amount to the subscription fees paid in the previous 3 months for users and the average income over the previous 3 months for Content Creators.
8.1 Although Covet-Me will investigate and act upon any complaints made about the Content posted on this Site, Covet-Me is not liable or responsible for any illegal or unlawful Content.
8.2 It is the sole responsibility of the Content Creator to maintain appropriate and legal Content.
9.1 Links to other Sites may be included on our Site, including links to social media networks such as Facebook and Instagram. Unless expressly stated, these Sites are not under Covet-Me control. Covet-Me neither assumes nor accepts responsibility or liability for the content of third-party Sites. This inclusion of a link to another Site is for information purposes only and does not imply any endorsements of the Sites themselves or of those in control of them.
10.1 Covet-Me may alter these Terms and Conditions at any time. If Covet-Me decide to do this, any such changes will become binding on all visitors when using and/or browsing our Site. All visitors are therefore advised to check this page and read out Terms and Conditions upon every visit to our Site.
11.1 These Terms and Conditions have been drafted in line and in accordance with the Data Protection Act 2018.
11.2 Use of this Site is governed by our Privacy Policy and Cookie Policy which can be found here (insert links). These polices are incorporated into these Terms and Conditions by this reference.
12.1 If any provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by the court other authority, these provisions shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.
13.1 These Terms and Conditions, the relationship between Covet-Me and Users or visitors of our Site (whether contractual or otherwise) shall be governed by, and construed in accordance with, the law of England and Wales.
13.2 Any disputes concerning these Terms and Conditions, the relationship between customers, visitors and Covet-Me, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the jurisdiction of the court of England and Wales.
